Types of Damages in Kentucky

Types of Punitive Damages

Punitive damages are less common than compensatory damages, but they can be awarded in cases where the wrongdoer's conduct was particularly egregious. Some examples of conduct that may warrant punitive damages include:

  • Intentional torts, such as assault and battery.

  • Negligence that is particularly reckless or careless.

  • Fraud or other intentional misrepresentation.

  • Malicious prosecution.

  • Abuse of process.
