Slip and fall accidents are a leading cause of personal injury claims in Kentucky. In fact, according to the National Floor Safety Institute, over 2 million people are injured in slip and fall accidents each year.

If you have been injured in a slip and fall accident, you may be entitled to compensation for your medical expenses, lost wages, pain and suffering, and other damages. However, it is important to understand the slip and fall laws in Kentucky before you file a claim.

In Kentucky, property owners have a duty to keep their property safe for visitors. This means that they must inspect their property regularly for hazards and take steps to correct any hazards that they find. If a property owner fails to meet this duty of care and someone is injured as a result, the property owner may be liable for the injuries.

To prove that a property owner was negligent in a slip and fall accident, you must show that the property owner:

  • owed you a duty of care;

  • breached that duty of care;

  • your injuries were caused by the breach of duty; and

  • you suffered actual damages as a result of your injuries.

If you can prove all of these elements, you may be entitled to compensation for your injuries.

What to Do if You Are Injured in a Slip and Fall Accident

If you are injured in a slip and fall accident, there are a few things you should do to protect your legal rights:

  1. Seek medical attention immediately. Even if you don't think you are seriously injured, it is important to see a doctor as soon as possible. This will document your injuries and help you get the treatment you need.

  2. Take pictures of the accident scene. If possible, take pictures of the area where you fell, including any hazards that may have caused your fall. This evidence can be helpful if you decide to file a lawsuit.

  3. Get the names and contact information of any witnesses. If there are any witnesses to your fall, get their names and contact information. This information can be helpful if you need to prove that you were not at fault for your accident.

  4. Report the accident to the property owner. As soon as possible, report the accident to the property owner or manager. This will help to establish a record of the accident and may help you if you decide to file a lawsuit.

  5. Contact an experienced personal injury attorney. If you have been injured in a slip and fall accident, it is important to contact an experienced personal injury attorney as soon as possible. An attorney can help you understand your legal rights and options and can represent you in court if you decide to file a lawsuit.
